This is getting ridiculous...losing my patience
I think a controlled slow movement is good at the beginning of the year. Last year they had made, for example, EB2 India as April 2004 but they had to make it U after 1st quarter.
So, a controlled slow movement will leave to more un-used numbers in the 3rd quarter when they will then be forced to make big jumps in dates to use up annual visa numbers

My wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

My followup question is since my prevoius H1B expired few weeks back, am I still eligible to apply 8th year H1B extension thru company B based on previously approved 140 (with company A)?

Hi,
Any cases where the underlying I-140 was withdrawn after 180 days of the 485 being pending(changed jobs using AC21) got approved recently?
I am current as per the July bulletin and would appreciate if some one else who is/was in a similar situation can provide their updates.

I am confused. Is it 120 days (4 months) or 90 days (3 months) before the expiry that one needs to apply for the EAD renewal.

I am on H1B, got my EAD and registered a LLC.
Do I need to send I-9 when I switch working for my own registered LLC?

Do know that once you switch to EAD, you are no longer in H1b. I-9 is just a form and if Home-land guys ask then you need to show them and no need to send that form to USCIS.
Could you please let me know how to register a LLC, I am in MA.

Unless you are getting your mother-in-law to the US before you get your GC, it may become a factor but otherwise, it will have no issue

I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

USCIS is one of the most greedy & inefficient organization. People in high offices should complaint about USCIS's Lie which their officials tells the congress all the time for adjudication delays. On one hand they say they are overwhelmed with too many applications, on the other hand they still issue 1 year advance parole, selectively 2 years EAD. They could easily make these documents valid for atleast 2 years, and have just one document for EAD & AP, but since they love to be overwhelmed with applications as they come the checks, they don't mind...

From my knowledge...
For now you can use EAD and continue to work.
In Long term you can get your GC refiled from a different company and port priority date

Can A2p the wages be pro rated ?
if monthly wages for an employees is 1000 per month then it should be 12000 per year) company need to prove the ability to pay $12000 per year.
but what if the LC was filed in mid year for example June 2005 and CIS RFE is asking to proof ability to pay (only One year) 2005
can it been showed as June - december = 7 month and onwards
$1000 x7= 7000
is it good approch or no

I think one always has to take PR claims with a few grains of salt (yes, including Canon's). As always, I'll wait for the reviews to come out before making any judgements, but I'm afraid unless Nikon does something about their lack of ultra-long primes with VR and their lack of any usable PC lenses, I'm going to be a Canon convert (if / when I go DSLR).

I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

Hello,
Could anyone please suggest me a few consulting companies who can sponsor H1B visa? I am trying to bring my friend who is in India working for an automotive OEM. He was in Michigan for a while and he went back to India and it�s been almost more than 7 years since he left but now he wants to come back to Michigan.
If anyone knows any consultants in Michigan would be perfect since I already have a job lined up (verbally) through my contacts but I am not successful finding an employer who can sponsor H1B for him.

Here is my case details. GC is under retrogression
PD is 09/2005, concurrently filed both I140 and 485, AP and EAD on Dec 2004at California Center , but employer located at NJ. According to attorney as I am working in CA, he has to file at CA. Dependent's 485 is not applied and now she is in US on H4. Never used AP and EAD. Working on H1 with GC sposor employer only.
I140 got approved in Aug 2005. Applied for 7 th year extension for me and dependent. Got approved for three years based on approved I140
Now I want to move to Texas and want to transfer H1 to new employer using AC21. Can I relocate from CA to Texas( In ETA forms Job location is mentioned as Undecided) and can I get 3 years H1 transfer approval through new employer?
New employer will give offer letter as Programmer Analyst with very good salary than current, but he is requesting to work as QA for some time at client place in Texas. Can I work in different job responsibilities at cleint though new employer's offer letter says Programmer Analyst with same job responsibilities mentioned in Labor?
Please advise me

It is very unikely that the US consulate in London will accept your visa application unless you have close ties to the UK. You will probably need to apply in India, or consider Canada or Mexico.

I asked my attorney and he said that the copies would be fine.
He sent me scanned receipt notices via e-mail and says that it will
be fine and not ready to send the originals for some reason.
Can you guys think of any reason attorney not willing to give the original receipt notices?

I don't think core is going to spill it's strategy on the forum for world to see. I would suggest you to join local chapter to know how things will be performed. :)
He He He, Yeah, and remember the can of worms that opned when they announced the short term plan to lobby for filing I-140 when visa numbers are unavailable. :D
