No it is not but the chances of getting a stamp is higher or at least it use to me.
I remember going through the same thing few years back but then economy was not as bad it is today. Always remember the guy's job at US Embassies is to stop people from coming or act like a gate keeper.
Just carry all your supporting documents like:
Tax returns
Offer letter
Letter from the company stating your continuous employment
Pay stubs
Bank statemen
ts and any assets you might have in the US (property, etc.)
Good luck

Guys,
I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

Hi !
Our lawyer had posted our application on July 2nd and we had our fingerprinting scheduled for 21st august which was completed.
I checked my status on the USCIS site for the very first time today. And it says. "On July 30, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case" . Can anyone kindly explain me what this means ( how July 30th and what mail are they talking about ?we never received any! ) ...

Hello --
Do any of you know what the A# is on the I-485 / I-130 / I-765 etc is for people who have previously held an F-1 / OPT-related A#? I have seen previous forums stating that OPT A#s begin with a "1" which connotes an OPT status; however I am not clear whether we are supposed to use that same A# on our I-485 and other GC-related documents, or leave that space blank.
Sorry this is redundant but previous posts don't seem to clarify a definitive answer to this question. Many thanks in advance.

I have filed for green card for my mother (all the required forms like I-130, I-485). My mom has an interview for the 29th of July. But unfortunately, due to her mom's demise and other family obligation like taking care of my dad she will not be able to come. Infact, she is not sure when she can come back. My question(s):
1) Can I withdraw my application for her green card (I-485, particularly)? So that I can file at a later date when things are in order.
2) If not, can I get postponement on the interview? and how far can we postpone it?
The questions arise because if we don't show up for the green card interview it is considered abandonment of the process, and can make it difficult (or maybe impossible) to get a green card in the future. If it wasn't for the family situation she would have been happy to be here.

We had a son in sep 2006 and named him Aaditya Balakandan Ravikumar with out any hassle in 2006 in GA at the same hospital(Northside)
But on April 3rd when we welcomed our daughter in to this world, at Northside hospital. The vital records guys at the hospital refused to put my husband's first name as my daughter's last name and said there is new law in GA, that says we should either name our daughter with mom's or dad's lastname or a combination of both and not father's first name.. This was really wierd to me in this free country..and no other state seem to have this, because my brother recently had a baby in NJ and named him with his first name with no trouble.
We wanted to name our daughter "Kaavya Magdalene Ravikumar" Instead the birth certificate has "Kaavya Magdalene KandaswamyBalasubramaniam" for now.
The SSN/Vital records government office guys refused to even discuss or explain the law and blankly said get a court order and we will change ur daughter's name.
Now we are in the process of taking this to court and changing her name to what we wanted before applying for passport etc..
FYI: I somehow feel like the law is suggesting that we can name our kid either on of these ways and not really enforcing...

Now, can I take up a job with a different title - say, "Finance Analyst" or "Corporate Finance"? I have been talking to various clients in California that are interested in offering me finance positions.

I fail to understand one fundamental thing with Immigration , GOP and Dems .
The GOP was againt latino immigration and had workplace raids with ICE agents and Dogs and Armed soilders ( we all know what they did ) . They Lost the elections and everyone said it is the lationo vote that caused their downfall.
Now come the Dems who are just dodging the ball cleverly , with Economy , healthcare , Wars all over the globe and so on and also care little about immigration. At tlest the workplace raids have stopped .
I am not latino and from India , as an outsider and onlooker to the entire immigration drama , I would want to ask what real choices do the latio voters have ? They just came out from the Fire( GOP Days earlier ) to Boiling oil( Dems Days now) and now they are complaining that they want to vote the govt out and bring back the old govt that had them in fire . I mean what is these threats all about , when either party does not seem to be interested in doing anything except for paying lip service ? With the current attitude of both the parties they have to either select Fire or boiling oil .

Hi,
I will be going for H1B stamping in feb/March at Mumbai Consulate.
In 2001 my F1 visa got rejected 3 times because I showed that I have sister in USA.
My sister is in still in USA. Now while taking H1B appointment in form I have again to mention yes or no (for the Que do you have any relatives in USA)
What I should do? What will be the effect if I said No? Do you think, VO will ask me that your F1 got rejected because you had sister in USA? So now did she came back?
Please reply me ASAP.

If you are on H-1, you cannot apply for L-1. You would have to work for a company outside the US for a period of 1 year before you can apply for a L-1 assuming you are in the US currently.
