I filed my 485 application at TSC at the beginning of August, still did not get any receipt number, neither are the checks cashed.

Any idea how long USCIS/TSC is taking these days to issue a receipt or cash the checks?

I know a colleague of mine who also changed from L1 to H1 last year but he joined his new job after 2 months from Oct 1 .

I have also read that only when you go out of the country and when you stamp your visa thats when one of the visa goes invalid.

Is this right?

Dude,

You are already out of status as you are not on L anymore. As of october 01st, your status changed to H-1b and you can only be employed by your H-1b employer.

Talk to a lawyer who knows L stuff (not many do) and straighten things out.

USCIS Expands I-140 Promium Processing to EB-1B (Outstanding Researcher) & EB-2 (Except NIW) Effective Next Monday, 09/25/2006

USCIS is scheduled to accept I-907 Premium Processing Request for Outstanding Researcher I-140 Petitions and Advanced Degree or Exceptionary Ability I-140 Petitions beginning from Monday, September 25, 2006. The categories of I-140 petitions which are excepted from the premium processing services are: EB-1A (Extraordinal Worker), EB-1C (Multinational Corporate Executive/Manager), EB-2(NIW).

TSC is not processing most EB3 I485. This is not supposed to be revealed publicly. It is wrong, so that's why I'm speaking out.

Since you are in H1B the employer would book your ticket to US and secondly, if in any case if you have to go back the employer would give you a return ticket back. That's what most of the employers do.
After reaching US, be active in IV forums as well as join the state chapter.

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

I'm not sure the need of physical office for GC, but for H1 transfer and extns you may get RFE for office photos, lease agreement (notarised copy) etc.

Hi,

I am planning to visit India next month. I will transit thru Dubai in Emirates Airlines from West Coast. My 485 is pending and have valid AP and EAD. I have expired H1B visa stamp in my passport.

Did anyone use AP in this route?. Will I have any issues with Emirates Airlines and during transit in Dubai using Advane Parole?.

Please someone help me.

My 485 is pending, so I think I won't be totally out of status..

Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?

I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )

I filed my H1B 3 months later after joining a new job on EAD , i didnt have any problem

According to this article on USCIS website "Petition Filing and Processing Procedures for Form I-140 (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=cfe8745543256210VgnVCM100000082ca60aRCR D&vgnextchannel=68439c7755cb9010VgnVCM10000045f3d6a1 RCRD)" on question#3 it clearly states that multiple I140 Petitions can be applied in different categories.

But I am not sure how this works when the first I140 is pending appeal.

Has anybody gone through this process.

Just get a letter addressed to Consular Office, US Consulate , City ( where your wife is scheduled for interview) . In the letter just mention in subject line "request to grant visa to spouse of Mr XXX" and in body just mention the details like Mr XXX is working with us since DATE As DESIGNATION and his salary is $XXXX. We request you to please grant his spouse Mrs XXX H4 visa so that she can join her husband in USA.
