    Hi ,

    I'm on H1B. Recently I joined new employer and the transfer is still in
    pending status.
    Among the documents required to sponsor for B2 visa, I'm supposed to
    send copies of I-797 and I-94. I have old employers H1B approval notice
    and I-94, but not of the new employers. I have the H1B receipt notice
    related to the new employer.

    Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
    interview in the US consulate with all the other essential documents
    including new employers H1B receipt notice without the new employer H1B
    approval notice.

    Any of your valuable suggestions are welcome.

    Company A attorney says I can apply for 3 year extension from B. Still waiting to hear from B's attorney. Did you check with your attorneys?

    There are really 2 sub-categories of EB-3. One requires a minimum of a bachelor's degree, or equivalent in education/experience. The other requires just 2 years skilled worker experience.

    The question is what your position really is, and what the employer requires. If the position really requires you to speak Korean, it can get approved. However, adding a foreign language requirement definitely invites intense scrutiny, and it can really only work if you can show that you spend a lot of your time using Korean and the company could not manage without it. You also need to show that you use Korean with people who cannot speak English, not just that they don't want to speak English. You need extensive back-up documents to prove the foreign language requirement.

    My Lawyer said that the Premium Processing for I-140 will be again available from 08/16/2007, he said he knows that 100%. Did someone have some information about this ??. Can this be true??

    No...but that is very interesting.

    if this comes true, then please share this lawyer's name on these forums so that everyone can benefit from his/her info channel into the USCIS.

    L1 visa is granted to people who have worked in the home country for the sponsoring company before coming to US. So, if you have worked in XYZ bangalore, you can get an L1 from XYZ to come to US. However, you are obviously working in the US for your present employer, so how could you have worked for the other company in the home country (Example - India)??

    Hi Everyone,
    I need help urgently , my port of entry is SFO and on the I94 I have not written my complete name as I didn't understand the the importance of I-94 . When I tried to apply for SSN i was told that the names has to match with the name written in I-94 at the port of entry and the person said that I have no other option to change the name so I agreed upon the name which on SSN . Now I googled out and came to know that I can change the name in port of entry . It would be of great help for me if any one can help me out getting out of this situation .

    my GC application was done in 2001 via my mom who is a GC holder.

    Will IV assist in legal non employment based GC application?

    or is IV only active in employment based GC issues?

    Where does that put us considering the house bill didn't even make it to markup today?

    I thought it was E-verify and our bill with some sunset bills. Now he excluded those things and added last item which Republicans never supports. So he is making this as suicide bill . This is all about politics. See how they turned back in last minutes. Now they created a image of Immi friendly but eventually they didn't fight for us. Bob was Anti in beginning and he introduce recapture so get our support now after becoming popular among us and our friends , relatives he is officially not stopping bill but killing it.

    In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.

    Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.

    You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

    this is just me, i would not go anywhere other than fidelity or vanguard..research more in the internet.

    i am switching employers and i have about 10k in my 401k with current employer. my next employer does not have the option to start 401k until after one year of service.i am looking for options to rollover my 401k to a IRA in a company. does anyone have any recommendations?thanks in advance

    Congrats all Minolta users, I know you've been waiting for this for a long time!

    I hope this is a winner, I really liked Minolta cause they ALWAYs gave the most camera at the best price. And their film cameras always screamed of class!

    Lets hope this camera can live up to my expectations, I just don't know how that image stabilization will work.

    My attorney sent me G-325A to fill up. It has 4 similar pages, where you need to enter your information. Now, my question is do I need to fill out all four pages with my information, and then fill out another 4 pages with my wife's info?

    Hello everybody,

    I just got an RFE for I-485...they are asking about marriage certificate and birth certificate...when I applied for I-485, I sent marriage certificate and birth certificate ..why they are asking me again to send?

    And can you tell me please what to do with the following.......Uscis sent me too an envelope where to put my documents for RFE.......but the docs dont fit in the small envelope...is it ok if I put my docs in a different and bigger envelope?

    My PD is sept 2005 ROW.
    If someone faced the same situation please help me with some advice.

    Hi Every one,

    I'm on OPT right now ,i'm done with my masters in DEC 2007.

    My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 24 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.

    I did't apply in 2009 even i have chance to apply(because of the JOB fear ) i got my OPT extension approved ,my OPT extension is going to end in June 2010 , any way i will be applying H1B in 2010.

    My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

    Hmm ... Are you still enrolled in your school as a student in good standing? AFAIK, you can avail CPT only during your study period, not after it.

    Hi,

    I've read conflicting information on whether one is eligible to receive unemployment benefits.
    Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.

    So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

    Yes, a derivative spouse can avail unemployement benefits and not jeopardize green card. Make sure she is eligible as per state laws. Each state has a different rule on who is eligible. Do some homework by calling your local unemployement office. I know of at least couple of immigration lawyers who discussed this on their newsletters. I know sheela murthy's website had that info too. Google for it and read.....

    You do NOT need to have an H4 visa stamped for change of status to H1, as long as you have a valid I-94. Don't worry.
