You can take time off -- like 4 weeks without any issue (I have done this), as long as the new company has filed to transfer your H1B petition.
I guess you should avoid going out of status -- where the old company has revoked your H1B when the new company hasn't even filed the H1B transfer petition. Other than this, taking time off between jobs should not be any problem at all, provided you stay within the country and, no travel outside the US. But if you do, you should consult your lawyer about its implications. Good luck with your new endeavors.

You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

My wife did her MBA and used her OPT before marriage. After a gap of OPT period she again went to school and got a MS degree. During her OPT, she did not work at all. Now she is unable to get second OPT for her recent MS degree.
Is there a way out to get second OPT? Can this new law (29 months OPT) if passed, be used to apply for second OPT.
What should be best approach? Please advice.

Fellows,
some body told me that if you are on H1B1 then you can not file for greencard. is it true?
I am on H1B1 and I have approved I-140.
I didnt knew the difference between H1b and H1B1.

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
The 140 approval notice is not required unless this is a post six year transfer/extension.

I am trying to schedule a visa appointment date and VFS website doesn't show any consulate except chennai!! can somebody please let me know what should be the reason? Last week, I was able to see Mumbai and Chennai and now Mumbai is gone! Is this because no appointments dates are available or something wrong with the website. My Employer applied for Labor on Aug 11th 2010 and yesterday we got the audit notice saying :
The application indicates the foreign worker is required to live on employer's premises although the application does not indicate the position is for a Live-in domestic. Please provide a detailed explanation indicating the reason the foreign worker must reside with the employer.
In ETA-9089 for Section H-17 question we have checked "Yes" but i guess it should be No.
We miss understood the question and thought it was asking about working at location and maked it yes.
my question is :
1) Can we make correction and send while replying to Audit (RFE)?
Please help on this.

It will be very helpful , if any one can clarify the new rule FATCA in regards to Indian NRI bank accounts. Will FATCA filing is required for Green Card Holders also.

thats very sad and bad on part of the HR. should always use fedEX, UPS for tracking such imp docs. anyways you can use Form I-824 Application for Duplicate Approval Notice.
google it and it should take around 3-5 months. friend of mine lost it at the photocopier and had to take this route.
