My Lawyer asked for the original letter from employer. She didn't even accept the scanned copy. I had to mail the letter to my lawyer.
If you have letter from employer then why not give original.

In OHIO I have successfully renewed my DL for 4 full years solely on original I-485 receipt.
On H1 they still give 1 year extensions.
Try doing the same in your state.

Hi All,
I just joined a new company and would like to use AC21 as I will be working on EAD. 140 is approved and 485 is pending for more than 180 days. New job is same or similar as per ONET job code.
My question is,
Is it necessary to involve your attorney or you can simply go ahead and file AC21 yourself?
I would like to what others have done? What kind of extra fees your attorney has charged for AC21?

There is nothing called AC21 filing ie AC21 does not have a form that you fill out etc.... generally Attorneys attach the docs with a covering letter citing the AC21 clause and from what I understand, these docs may/may not get into your file.
The advantage of using an Attorney is,
(1) G28 filing - Attorney will get communication and be in position to respond or guide appropriately
(2) NOID, RFE and denials might happen and MTR may have to be filed.
Most times, issues arise when old employer withdraws the 140 petition.
USCIS needs to have a better way of handling this and avoid unnecessary tensions and errors

The answer is Yes you can switch to new employer. Your H-1 does not matter anymore as you have applied for AOS and you have a valid EAD which you can use for AC21 portability for a new employer after 180 days.

1)My I 94 expires in 2 months.I don't want to extend H1 and I want to use EAD.So how can I extend my I94 if I start using EAD?
2)I finished 4yrs of stay on H1B. If I don't extend H1B now and start using EAD, if by any reason my 485 denies in future, can I switch back to my H1B and work for the remaining 2yrs on H1B?

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

CIS is bound by law to not accept early AOS applications. It depends on State published visa dates. So if we can work with State dept to have them publish the dates for Visa posts for CP as they do today (Which is faster) and add CIS processing delay to the Dates and publish second set of dates for AOS which always be atleast 2 years or more added to current dates published by State.
This gives chance to people, who missed their chance to file in AOS in 2007 July. They can atleast get benefits of AC21 in this tough economy.

Option 1: you can get someone to take your photograph with a digital camera and then use Passport photos for free - ePassportPhoto.com (http://www.epassportphoto.com) to make sure that it is cropped to size and meets the size requirements. You will need to ensure that the picture is taken correctly though (without shadows, against a plain light background, etc.). You can get more details about the photo requirements from:

Option 2: You can also go to any place like Costco or Walgreens and have them take your picture and upload the scanned version of the picture.

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

This is the sort of news we should publicize.
Here is a clear example of business leaders moving ahead of the politics of this issue. It will have an impact on any sensible person.
It should get onto as many news wires as possible. Which sensible person can say that those 1000 high paying jobs going to Vancouver/Canada is in the interest of Seattle/USA. Imagine to spin off losses of this, to housing, to retail, to all sorts of areas of the economy where many Americans make their livelihoods.
This is what people don't understand, push them too far and capitalists will weaken the US economy.

I am in the same situation . The responses from the lawyer are Incorrect .I spoke to my companies attorney and they advised me to apply the H4 extension in Premium and then go with the new H1 in regular so that your H4 ext will be approved first and able to maintain the status until Oct 07
